Obligations of New York Water Taxi
Without limitation, New York Water Taxi is not responsible for any injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of, or failure to provide, any goods or services occasioned by or resulting from (but not limited to) acts of God or force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical failures, lack of medical care, or for any other cause beyond the direct control of New York Water Taxi.
Obligations of the Client
Client agrees to protect, defend, indemnify and save New York Water Taxi harmless from and against all claims, demands, and causes of action of every kind and character for bodily injury, death and/or property damage, without limit and without regard to the cause or causes thereof or the negligence of the “Client”, arising in connection with the Client's use of New York Water Taxi's vessel(s).
No contraband of any kind will be permitted on board.
Client shall be responsible for ensuring compliance with New York Water Taxi's policies and all applicable laws and regulations governing consumption of alcoholic beverages, including but not limited to all laws governing age of consumption of alcoholic beverages. Upon the safe disembarkation of passengers, Client shall be responsible for providing any subsequent transportation arrangements to visually intoxicated passengers from the Charter drop-off location.
Marine Conditions and Weather
New York Water Taxi vessels have a fully enclosed cabin and are comfortable in all weather conditions. If you cancel your charter because of the weather, because of your illness or the illness of any guest or for any other reason, you will be responsible for payment of the percentage of the Vessel Charter Price specified above, depending on the time of cancellation.
Under law and maritime custom, while underway the Captain of the vessel is responsible for the safety of the vessel and the well being of its passengers. All directives of the Captain while the vessel is underway must be followed by you and your guests. Failure of you or your guests to do so may result in an early termination of the charter by the Captain. There will be no refunds under such circumstances.
If the Captain determines that weather conditions, mechanical difficulties with the vessel or any other occurrence makes it unsafe to sail, the charter may be terminated by the Captain at any time. In such event you will receive a full refund of the Vessel Charter Price, but New York Water Taxi will not be liable for any other expenses you may incur or any other consequential damages.
